Meteo24 General Terms and Conditions of Use
- The Meteo24 website (the "Website") is owned and operated by MeteoGroup UK Limited of 292 Vauxhall Bridge Road, London SW1V 1AE ("MG", "we" or "us"). Your access to and use of the Website and the Content is subject to these Terms and Conditions. By browsing the Website you are accepting that you are entering into an agreement (the "Agreement") on the current terms and conditions. You should check these each time you revisit the Website.
- All content appearing on the Website including, but not limited to, text and data (the "Content") is owned by MG or its licensors. All copyright, database rights and all other intellectual property rights in and relating to the MG name and the Content are owned by MG or its licensors. No part of the Website may be reproduced or displayed in public, communicated to the public or used for any other purpose than viewing the Website without the consent of MG. You may not amend, edit, frame or modify all or any of the website without the express written permission of MG.
- You are permitted to use the Content (whether free or paid-for) for your personal, non-commercial use only.
- Whilst every effort is made to ensure the accuracy of the service, MG accepts no responsibility for any use made of the information provided and shall not be liable for any loss suffered thereby (except for direct loss suffered by you to the extent arising out of MG's negligence or wilful default) to the fullest extent that MG may exclude or limit such liability at law.
- You agree that your use of the Website is on an "as is" and "as available" basis and that your use of the Website is at your sole risk. On that basis, except as expressly set out in these terms, MG does not enter into conditions, warranties or other terms in relation to the Website (including any implied term relating to quality, fitness for a particular purpose).
- MG's total liability arising from or in connection with the Website and the Content (and whether the liability arises because of breach of contract, negligence or for any other reason) shall in relation to all events or series of connected events occurring in any given calendar year be limited to the amount of any charges paid or payable by you in that calendar year (to be calculated on a pro-rata basis from fees paid or payable during part of a calendar year if the relevant calendar year has not been completed at the time the claim is made).
- All of the terms agreed between the parties in relation to the Website and the Content are expressly set out in these General Terms & Conditions of Use and the parties do not intend any other terms to apply unless we expressly agree otherwise in writing or by e-mail.
- MG's use of your personal information is governed by MG's Privacy Policy which forms part of these Terms and Conditions. In the event that MG undergoes reorganisation or is sold to a third party, you agree that any personal information MG holds about you may be transferred to that reorganised entity or third party.
- These terms and conditions shall be governed and interpreted in accordance with English law, and you consent to the non-exclusive jurisdiction of the English courts.
- We may assign or transfer the Agreement or all or any of our rights and/or obligations under the Agreement to any MG Group company. You may not assign or sub-license the Agreement in whole or in part without our prior written consent. "MG Group" means MeteoGroup UK Limited (or any holding company of it) and each subsidiary (both "holding company" and "subsidiary" as defined in the Companies Act 1985 as amended by the Companies Act 1989) from time to time of MeteoGroup Limited (or any holding company of it).
- The failure or delay by either party to enforce any of its rights under the Agreement shall not be a waiver of such rights or any other rights.
- For the purpose of Section 1(2) of the Contracts (Rights of Third Parties) Act 1999, no term of the Agreement shall be enforceable by a third party.
- If any provision of the Agreement is held to be void or unenforceable in whole or in part, this shall not affect the validity or enforceability of any other provision or the Agreement as a whole, and the parties will renegotiate the provision in good faith to achieve the same objects.
